These Terms of Service (“Terms”) govern your access to and use of Akalan and related services offered by Koderscare Technologies Pvt Ltd (“we”, “us”). By creating an account or using the Service, you agree to these Terms.

2. The Service

Akalan provides AI-assisted mock interviews, feedback, and reports for practice and preparation. Output is generated automatically and may contain errors. The Service is not a substitute for professional career, legal, or human-resources advice.

3. Accounts and eligibility

You must provide accurate information and keep your login secure. You are responsible for activity under your account. We may suspend or terminate accounts that violate these Terms or harm the Service or other users.

4. Acceptable use

You agree not to misuse the Service, including by attempting to:

• Access non-public systems, probe for vulnerabilities, or overload our infrastructure.
• Reverse engineer or scrape the Service in violation of applicable law or our technical measures.
• Upload unlawful content, malware, or material that infringes others’ rights.
• Use the Service to build a competing product without our written consent.

5. Fees and payments

Paid features, if offered, are billed according to the pricing shown in the product. Payments may be processed by third-party providers. Taxes may apply as required by law. Unless stated otherwise, fees are non-refundable except where mandated by law or our policy at the time of purchase.

6. Intellectual property

We and our licensors own the Service, branding, and software. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial practice unless we agree otherwise in writing.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE INTERVIEW OUTCOMES OR EMPLOYMENT.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Koderscare Technologies Pvt Ltd AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR ONE HUNDRED INDIAN RUPEES (INR 100), WHICHEVER IS GREATER, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

9. Indemnity

You will defend and indemnify us against claims arising from your use of the Service, your content, or your violation of these Terms, to the extent permitted by law.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access for operational, legal, or security reasons. Provisions that by their nature should survive will survive termination.

11. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Subject to mandatory provisions, courts in India shall have exclusive jurisdiction over disputes arising from these Terms or the Service.
